1. Eligibility

2. Description of the Service

NerdBallerTV Live allows users to purchase interactive livestream features, including but not limited to:

• AI-generated Text-to-Speech (TTS) messages
• Voice messages
• Media sharing
• Interactive livestream participation
• Future digital engagement features

Features may change at any time.

3. User Accounts

You may:

• Sign in using Kick (when available)
• Use the Service as a guest (where permitted)

You are responsible for maintaining the security of your account. You may not impersonate another person or intentionally misrepresent your identity. Users authenticated through Kick may have their identity verified before certain features are accepted.

4. Payments

Payments are securely processed through Stripe. By submitting payment, you authorize the applicable charges. Prices may change at any time. Minimum donation or purchase amounts may vary by feature.

5. Refund Policy

Because purchases involve digital services that may be delivered immediately:

• Payments are generally non-refundable once the content has been approved, played, or otherwise delivered.
• If content cannot be delivered due to a technical issue, duplicate payment, or other circumstances determined by us, we may issue a refund at our sole discretion.
• Approved or completed livestream interactions are not eligible for refunds solely because you changed your mind or were dissatisfied with the content after it was delivered.

6. Content Moderation

All submitted content may be reviewed before appearing on stream. We reserve the right to:

• Reject submissions
• Edit or truncate content where appropriate
• Refuse service
• Remove media
• Cancel interactions
• Suspend or ban users

We are not obligated to explain moderation decisions.

7. Prohibited Content

You may not submit content that includes:

• Illegal material
• Threats or harassment
• Hate speech
• Defamatory statements
• Spam
• Malware
• Fraudulent content
• Copyright infringement
• Personal information belonging to others
• Sexually explicit material
• Content encouraging violence or criminal activity

Violation may result in removal, suspension, or permanent bans.

8. Public Display

You understand and agree that submitted content may be:

• Displayed publicly
• Read aloud during livestreams
• Recorded in livestream archives
• Shared in clips
• Featured in promotional content
• Viewed by the public

Do not submit information you wish to remain private.

9. Intellectual Property

You retain ownership of your submitted content. By submitting content through the Service, you grant NerdBallerTV Live a worldwide, non-exclusive, royalty-free license to display, broadcast, reproduce, record, archive, distribute, and promote submitted content in connection with the Service. This license continues for archived livestreams and promotional materials.

10. Availability

We do not guarantee uninterrupted availability. The Service may be modified, suspended, or discontinued at any time without notice.

11. Third-Party Services

The Service relies on third-party providers, including Stripe, Kick, ElevenLabs, Supabase, and Cloudflare. Your use of those services is also subject to their respective terms and policies. We are not responsible for third-party outages or actions.

12. Limitation of Liability

To the fullest extent permitted by law, NerdBallerTV Live and its owners, employees, contractors, affiliates, licensors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Service. Our total liability for any claim shall not exceed the amount you paid us for the specific transaction giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless NerdBallerTV Live, its owners, employees, affiliates, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your submitted content, your violation of these Terms, and your violation of applicable laws or third-party rights.

14. Termination

We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or if we reasonably believe doing so is necessary to protect the Service, other users, or our business.

15. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that messages will always be displayed, content will always be approved, livestreams will occur as scheduled, or third-party services will remain available.

16. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Travis County, Texas, unless applicable law requires otherwise.

17. Changes to These Terms

We may update these Terms from time to time. Updated versions become effective upon posting to the Service. Your continued use of the Service constitutes acceptance of the revised Terms.
